Litigation Or Negotiation? Is One Better Than The Other?

Popular culture often portrays divorces and custody proceedings as contests to be won or lost. While they sometimes turn out this way, this should not be the intended outcome.

Rhodes Ferguson & Stone, LTDIf you and your spouse or co-parent can negotiate the terms of your divorce or custody case amicably, you will likely save considerable time, money and stress. More importantly, negotiation gives each of you more control over the outcome of the case, and it tends to be far better for the well-being of your children.

At Rhodes Ferguson & Stone, LTD., we encourage negotiation most of the time for the reasons listed above. While our lawyers do not serve as mediators, we can represent you in mediation and other forms of alternative dispute resolution (ADR).

It should be noted that mediation is only possible by the joint effort of both parties. If your spouse refuses to negotiate in good faith, we are fully prepared to pursue your interests in court.

Where Will Your Case Be Heard?

Virginia utilizes two different types of courts for family law cases. If your family law issue is a divorce or stems from a divorce (such as child custody prompted by divorce), your case would be heard in circuit court. For family law actions that do not stem from divorce (unmarried child custody matters, for instance), the case would go to Juvenile and Domestic Relations Court.

Our firm regularly practices in both kinds of courts, and we are ready to assist you in either setting.
